EPA to Cease Accepting Expedited Corrections to TSCA Inventory

On February 24, the EPA announced that it will stop accepting streamlined requests to correct entries on the TSCA Inventory of Chemicals in Commerce as of April 26, 2022.  Historically, the Agency has allowed corrections to chemical identities using the same forms and documentation used to add an existing chemical to the inventory.  This practice greatly streamlined and expedited the ability of industries to correct mistakes made in initial filings.  Under the EPA’s new policy; however, the Agency will require any changes to go through the same pre-manufacture notice (“PMN”) process required for completely new chemicals.   The decision has already… Read more

U.S. v. Arthrex Case Creates a New Path to Challenge IPR Decisions

As a result of yesterday’s Supreme Court’s decision in U.S. v. Arthrex, any party dissatisfied with the result of an Inter Partes Review (IPR) can now seek review by the Director of the Patent and Trademark Office (PTO). Previously, and as codified by the America Invents Act (AIA), IPR decisions were appealed directly to the U.S. Court of Appeals for the Federal Circuit, with no possible review at the PTO.  Yet to be determined will be the details of how this extra appeal step is to be implemented.   And will, for example, the Director really have time, resources and responsibility for reviewing… Read more

SGR Partner Scott Woldow was recently featured in the International Trademark Association’s monthly bulletin regarding a Panel Discussion Scott gave to the Trademark Examination Division.  The topic he spoke on was called “A View from the Outside”.  Former Trademark Examiners discussed the differences between being an Examiner with the USPTO and being a trademark attorney in outside practice.
