Smith, Gambrell & Russell Wins Federal Circuit Appeal for Patent Interference

ATLANTA (February 10, 2017) – Smith, Gambrell & Russell, LLP (SGR) is pleased to announce the firm’s win in the U.S. Court of Appeals for the Federal Circuit on behalf of client, Yang (16-1214). The Court’s ruling affirmed the SGR legal team’s previous success before the Patent Trial and Appeal Board (PTAB) in Interference No. 106,025, which resulted in judgment against Chan and cancellation of a number of claims of Chan’s U.S. Patent No. 8,614,197. A previous interference proceeding between Yang and Chan (Interference No. 105,982) resulted in the cancellation of the majority of claims of Chan’s U.S. Patent Nos. 7,262,285 and 7,524,824.

The SGR legal team was led by Partner Stephanie Scruggs who argued the appeal. Ms. Scruggs is Managing Partner of SGR’s Washington DC office and Head of the Intellectual Property Section in the Washington D.C. office. Associate Jessica Zurlo, Counsel Tom Wiseman, and Counsel Michael Schwartz were also attorneys for Yang in the ʼ982 and ʼ025 interferences before the PTAB.
